These Terms of Service (“Terms”) govern your access to and use of Aetherra, including all games, websites, accounts, cloud save services, multiplayer systems, community features and related services (collectively, the “Service”).
By creating an account, accessing the Service, or continuing to use the Service after these Terms become effective, you agree to be legally bound by these Terms and our Privacy Policy.
If you do not agree, you must not use the Service.
About Aetherra
Aetherra is an independently operated online gaming platform developed and operated by Adam Rasul Brooks, an Australian sole trader (“Aetherra”, “we”, “our”, or “us”).
The Service currently consists of multiple browser-based games sharing a common account system, cloud save platform and progression ecosystem. Features may be added, modified or removed over time.
Eligibility
You must be at least 13 years old to create an account or use account-based features.
If you are under the age of legal majority in your country, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
The Service is not directed toward children under 13 years of age. If we become aware that an account belongs to someone under 13, we may suspend or permanently remove that account.
Your account
You are responsible for maintaining the confidentiality of your account credentials.
You agree to:
- provide accurate information;
- keep your password secure;
- keep your recovery email current;
- promptly notify us of unauthorised account access.
You remain responsible for activity performed using your account unless required otherwise by applicable law. You may delete your account at any time in Account settings.
Usernames
Usernames and display names must not:
- impersonate another person;
- impersonate Aetherra staff;
- infringe intellectual property rights;
- contain hate speech;
- promote violence;
- contain obscene or unlawful material;
- encourage scams or fraud.
We reserve the right to change or remove usernames that violate these rules.
Acceptable use
You agree not to:
- cheat;
- exploit bugs;
- intentionally abuse game mechanics;
- automate gameplay without permission;
- interfere with multiplayer services;
- attack our servers;
- reverse engineer the Service except where permitted by law;
- scrape our databases;
- upload malware;
- attempt unauthorised access;
- distribute cheats;
- interfere with other players' enjoyment of the Service.
You also agree not to use the Service for illegal activities or commercial purposes without our written permission.
Enforcement
Where we reasonably believe these Terms have been violated, we may take one or more of the following actions:
- warnings;
- leaderboard removal;
- achievement removal;
- cloud save rollback;
- save reset;
- temporary suspension;
- multiplayer restrictions;
- permanent account termination;
- removal of user-generated content;
- restriction of future account creation.
Nothing in this section limits any other rights available to us under law.
Service availability
The Service is provided on an ongoing basis but availability is not guaranteed.
We may:
- perform maintenance;
- install updates;
- suspend features;
- migrate servers;
- modify gameplay;
- rebalance mechanics;
- discontinue games;
- permanently retire services.
Scheduled maintenance may occur without advance notice where reasonably necessary.
Cloud saves
Cloud saves are provided as a convenience.
While we make reasonable efforts to preserve saved progress, we cannot guarantee that game progress will never be lost due to hardware failure, software bugs, synchronisation conflicts, hosting failures, internet outages, corruption, or force majeure events.
Where supported, users are encouraged to maintain local backups.
Multiplayer services
Some games include online matchmaking, multiplayer rooms, shared leaderboards and community interaction. These services may be modified or discontinued without notice. Access to multiplayer features may be restricted where necessary to maintain the integrity or security of the Service.
Virtual content
Game progress, achievements, cards, decks, unlocks, currencies, cosmetic items and other virtual content are licensed to you for personal entertainment purposes.
They:
- are not owned by you;
- have no monetary value;
- are not redeemable for cash;
- may be modified or removed;
- may be reset as part of gameplay balancing or enforcement.
Unless expressly stated otherwise, no virtual content constitutes property.
Purchases
The Service currently contains no paid features. If paid features become available in the future, additional purchase terms, refund policies and consumer rights disclosures will apply.
Intellectual property
The Service, including but not limited to artwork, music, sound effects, game systems, source code, graphics, icons, stories, lore, maps, characters, names, logos, trademarks, interface designs and documentation, are owned by or licensed to Aetherra.
Nothing in these Terms transfers ownership of our intellectual property. You receive a limited, non-exclusive, revocable, non-transferable licence to use the Service for personal, non-commercial entertainment.
User content
You retain ownership of original content you create.
By submitting content through the Service, including usernames, decks, team compositions and future community content, you grant Aetherra a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and process that content solely for operating, improving and promoting the Service.
This licence ends when the content is deleted unless continued retention is reasonably necessary for legal, security or operational purposes.
Streaming and content creation
We encourage players to create livestreams, gameplay videos, screenshots, guides, tutorials and reviews. Monetisation through platforms such as YouTube and Twitch is permitted provided the content does not redistribute standalone assets, does not falsely imply endorsement, and complies with these Terms.
AI features
Some features may include AI-controlled opponents or algorithmically generated gameplay. AI behaviour may occasionally produce unexpected or unintended results. Such behaviour does not constitute a defect unless required by applicable law.
Third-party services
The Service may integrate with third-party providers including Google, Discord, Twitch and Fly.io. Use of those services remains subject to their own terms and privacy policies. We are not responsible for third-party services beyond our reasonable control.
Suspension and termination
You may stop using the Service at any time.
We may suspend or terminate access where reasonably necessary to:
- protect players;
- investigate abuse;
- protect infrastructure;
- comply with law;
- enforce these Terms;
- discontinue the Service.
Where appropriate, we may provide notice before termination.
Account inactivity
Subject to applicable law, we may permanently delete accounts that remain inactive for an extended period. Where reasonably practical, advance notice will be provided before permanent deletion.
Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE”. We do not guarantee uninterrupted availability, error-free operation, permanent preservation of game progress, or compatibility with every browser or device.
Nothing in this section limits rights that cannot legally be excluded under applicable consumer protection laws.
Limitation of liability
To the maximum extent permitted by law, Aetherra shall not be liable for indirect, incidental, consequential, exemplary or punitive damages, including loss of profits, goodwill, game progress or data.
Where liability cannot legally be excluded, our total liability is limited to the greater of the total amount paid by you to us during the twelve months before the claim, or AUD $100.
Some jurisdictions do not permit certain limitations, and those limitations will apply only to the extent permitted by law.
Indemnity
You agree to indemnify and hold harmless Aetherra from claims arising from your misuse of the Service, your violation of these Terms, your unlawful conduct, or your infringement of another person's rights.
Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, cyber attacks, internet failures, hosting outages, power failures, governmental actions, labour disputes, acts of war, pandemics, or other force majeure events.
Changes to the Service
We may modify, replace or discontinue any part of the Service at any time. Material legal changes may require users to accept updated Terms before continuing to access account-based features.
Governing law
These Terms are governed by the laws of the State of Victoria, Australia. Nothing in these Terms limits mandatory consumer protections available under applicable law.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aetherra regarding the Service.
